Student Visas (Subclass 500)

A student visa is a temporary visa which allows you to remain in Australia to study for the duration of your course. Courses types range from general english courses to university level courses. As an Australian International student in most cases you will be permitted to work a maximum of 40 hours per fortnight or 20 hours per week. In some cases you will be permitted to work full time.

VISITOR VISA

Visitor Visa

There are three different types of visitor visas available to visit Australia:

  • E-Visitor visa (subclass 651) – only for eligible passport holders mainly from European countries who wish to visit Australia for tourism or business purposes.
  • Electronic Travel Authority (subclass 601) – only for eligible passport holders mainly from some non-european countries who wish to visit Australia for tourism or business purposes.
  • Visitor visa (subclass 600) – if you are not eligible for one of the visas above or if you would like to extend your stay in Australia, you will need to apply for a Visitor 600 visa. This visa consists of four different streams:
    • Tourist stream – includes holidays, recreation and seeing family and or friends.
    • Business Visitor stream – includes attending a conference, negotiation or business meetings.
    • Sponsored Family stream – for those interested in visiting their family in Australia, applicants will need to meet the migration regulations definition of ‘family’.
    • Approved Destination Status stream – for people from the People’s Republic of China who are travelling in an organised tour group.

Skilled Temporary Graduate Visa (Subclass 485)

The Skilled Graduate Visa allows international students who have completed their study to live, work and study temporarily anywhere in Australia. This visa consists of two streams: the Graduate Work stream and the Post-Study Work stream.

Many students apply for this visa whilst working on requirements to apply for permanent residency. You may be able to proceed to apply for permanent residency if you meet all requirements.

PARTNER VISA

Are you in a relationship with an Australian citizen, permanent resident or eligible New Zealand citizen?

The Partner visa, also known as the Spouse visa allows a spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia.

You can apply for a partner visa either onshore or offshore, that is, in or outside Australia however you must meet certain requirements in order to be eligible to apply.

In most cases, eligible applicants are granted temporary residency initially before they can qualify for permanent residency. Depending on your circumstances you may be eligible to apply for permanent residency without having to satisfy the initial temporary residency requirements. If a relationship ends, an applicant may still be eligible to remain in Australia however only if particular circumstances exist.

The most important thing to consider when applying for a Partner visa is that you must be able to prove that you are in a genuine and continuing relationship. Various aspects of your relationship are assessed including social, financial, If you are in a de facto relationship you must meet specific criteria to prove that you live together. If you are married, your marriage must be recognised under Australian law. If you are not married and do not live with your partner however you plan to marry, you may be eligible for a Prospective Marriage visa. Same-sex couples can also apply for this visa if they are in a de facto relationship.

You must also meet health and character requirements to obtain this visa.

If you do not meet all criteria according to Australian Migration legislation, in some cases, it may still be possible to obtain a Partner visa depending on your circumstances.

Entrepreneur/Business Visa

The Entrepreneur visa is part of the Business Innovation and Investment visa programme which allows applicants to establish a new business or develop an existing business in Australia. The new Entrepreneur stream is available for entrepreneurs who wish to develop and commercialise their innovative ideas in Australia.

Most requirements outlined for the Entrepreneur stream apply also for other business investment streams such as the Business Innovation stream, Investor, Significant Investor and Premium Investor streams however applicants must be able to prove that they have at least $800,000 to invest in government shares. A points test also applies for some streams which is based on factors such as age, English language ability, qualifications, business experience, net personal and business assets, business turnover and innovation. Minimum residency requirements also apply in most cases in order to be granted permanent residency.

Key facts

Key facts and main requirements for the Business Innovation and Investment (Provisional) visa (Subclass 188), Entrepreneur Stream are as follows:

  • Initially a temporary visa for up to 4 years.
  • Entrepreneurs will require $200,000 in funding from a specified third party to grow a venture in Australia. One or more funding agreements must be in place for at least $200,000 between the entrepreneur or venture and a third party funding body or bodies. The funding agreement must involve the transfer of at least 10% of the funds within 12 months of commencing the activity in Australia.
  • Applicants must be under 55 years of age, although a state or territory can waive this requirement if you can prove that your proposed complying entrepreneur activity will be of exceptional economic benefit to the nominating state or territory.
  • Applicants must be undertaking or proposing to undertake a complying entrepreneur activity in Australia and have a genuine intention to continue this activity.
  • Applicants must hold at least 30 per cent interest in their entrepreneurial venture.
  • Applicants must have competent English, the equivalent of an English IELTS score of 6 in each component *an exemption may apply in some cases.
  • The applicant’s business must be nominated and sponsored by a state or territory government or Austrade on behalf of the Australian government.
  • An expression of interest (EOI) will need to be submitted.
  • Applicants must be invited to apply for the visa through the skill select system.
  • Applicants must provide a detailed business plan outlining their plans for the venture in Australia.
  • There is no requirement to show a minimum amount of personal net assets or significant business background.
  • Applicants may be required to provide evidence of business experience and/or qualifications.
  • An Entrepreneur visa holder can progress to permanent residency (subclass 888) after four years and in some cases earlier if they can prove business success, this includes factors such as business turnover, employment of Australians and ability to obtain significant financial backing. To qualify for permanent residency, applicants must have also been in Australia on the 188 visa for one year in the two years immediately before lodging the permanent residency application.
